Issuance of Cards

The Nepal Investment Bank Limited (“Nepal Investment Bank”) may issue the Healthcare Card to the Cardholder on the request of the Buyer and pursuant to the Buyer making an application for the Healthcare Card and agreeing to the applicable terms and conditions in the manner prescribed by Nepal Investment Bank in this regard. Nepal Investment Bank shall maintain records of these Applications and other consents/instructions in such manner as may be deemed suitable by Nepal Investment Bank.

At the time of making the application for issuance of the Healthcare Card, the Buyer can chose any amount as prescribed in tariff to be loaded on Card. Reloading of amount is possible any time as per the tariff specified by the Nepal Investment Bank subject to internal and applicable regulatory and statutory guidelines.

The Cardholder shall be able to use the Card only to the extent of the amount loaded onto the Card at the time issuance or loaded. The Card shall be activated subject to the desired amount being loaded on the Card by the Buyer, as the case may be by the means of Cash/ Debit mandate/cheque/ pay order / demand draft / funds transfer as is acceptable to Nepal Investment Bank. Such funds shall be loaded on the Card after deduction of the applicable charges/ fees etc. payable by the Buyer to Nepal Investment Bank for availing the said Card facility.

The Cardholder and the Buyer shall be bound to comply with the terms and conditions and all the policies stipulated by Nepal Investment Bank from time to time in relation to the Healthcare Card. Nepal Investment Bank may, at its sole discretion, refuse to accept the application or to issue Healthcare Card to the Cardholder.


Features of card

The Cardholder may use the Card to make payments to our network healthcare partners at merchant establishments within Nepal &India and may get discounts as per agreed terms and conditions. The facility of balance transfer from one Card to another, cash withdrawal facility, internet banking facility and the facility to make offline / MOTO transactions shall not be available on the Healthcare Card. No interest shall be payable by Nepal Investment Bank on the amount available/loaded on the Card.


Lost or stolen Cards

If a Card is lost or stolen, the Cardholder must file a report at the local police station and send a copy of the same to Nepal Investment Bank. The Cardholder must immediately report the loss/theft over the telephone to any of Nepal Investment Bank' s 24- Hour Customer Care Centers.

Nepal Investment Bank shall, upon adequate verification, hotlist/cancel /suspend the Card and terminate all facilities in relation thereto during working hours on a working day following the receipt of such intimation and shall not be liable for any inconvenience caused to the Cardholder in this regard. The Cardholder shall take cognizance of the fact that once a Card is reported lost, or stolen and is subsequently found, the same shall be promptly cut in half, returned to Nepal Investment Bank and adequate care taken to prevent its misuse. The Cardholder is responsible for the security of the Card and shall take all steps towards ensuring the safekeeping thereof. The Cardholder will be liable for all charges incurred on the Card until the Card is reported lost / stolen. Further, in the event Nepal Investment Bank determines that the aforementioned steps are not complied with, financial liability on the lost or stolen Card would rest with the Cardholder.In case of any dispute relating to the time of reporting and/ or transaction/s made on the Card or any other matter in relation to the said Card, Nepal Investment Bank shall reserve the right to ascertain the time and/ or the authenticity of the disputed transaction.


Surrender/Replacement

The Card issued to the Cardholder shall remain the property of Nepal Investment Bank and shall be surrendered to Nepal Investment Bank, on request. The Cardholder shall return the Card to Nepal Investment Bank for cancellation in the event the services are no longer required by the Cardholder or if the services are withdrawn by Nepal Investment Bank for any reason whatsoever.

Nepal Investment Bank may issue a replacement Card to the Cardholder upon a request being made by the Buyer, in this regard and at its sole discretion. The replacement Card shall be sent to the address of the Buyer, as is registered and available with Nepal Investment Bank or at the designated Nepal Investment Bankbranches, as is deemed necessary, by Nepal Investment Bank requiring the Buyer to have the same collected from the designated branch. In the event of the death of the Cardholder, a new replacement Card may be issued to the legal heir of the Cardholder by Nepal Investment Bank, upon a request for the same being made by the Buyer on the same terms and conditions or such other terms and conditions as Nepal Investment Bank may deem fit and subject to producing the required documents evidencing the legal heir status and any other document as required by Nepal Investment Bank in this regard. In case of the permanent total disability of the Cardholder, a new replacement Card, on the same terms and conditions or such other terms and conditions as Nepal Investment Bank may deem fit, may be issued in the name of the person specified by the Cardholder, subject to a request for such an issue being made by the Buyer. The issuance of the replacement Card shall be as per the internal policies and procedures of Nepal Investment Bank and shall be subject to applicable laws.


Termination

The Card is valid upto a period of one/two/three year from the date of issuance of the Card. However, it is subject to payment of annual fee paid on the Card. Nepal Investment Bank may, at any time, with or without notice, at its absolute discretion, terminate the Card.


Usage guideline

The said Card is valid only in Nepal and India. The Cardholder shall at all times ensure that the Card is kept at a safe place and shall under no circumstances whatsoever allow the Card to be used by any other individual. The Cardholder shall sign the Cardat the appropriate place provided on the reverse side of the Card immediately upon receipt. The Cardholder shall be responsible for all facilities granted by Nepal Investment Bank and for all related charges and shall act in good faith in relation to all dealings with the Card and Nepal Investment Bank.


Liability in case of service provider transactions

Service Provider : VISA/MASTERCARD/AMERICAN EXPRESS

In case of VISA / Master Card / American Express Cards, the liability of the Cardholder for disputed, unauthorized VISA / Master Card / American Express transactions shall be limited to zero provided the Cardholder notifies Nepal Investment Bank in writing immediately of such disputed, unauthorized transactions and the Cardholder is not , in the opinion of Nepal Investment Bank, guilty of negligence, fraud or collusion etc. Provided, however, the liability of the Cardholder in respect of disputed, unauthorized VISA / Master Card/ American Express transactions carried out under loss or stolen VISA / Master Card/ American Express Cards shall be limited to zero only if such disputed, unauthorized VISA / Master Card/ American Express Transactions have been done within a period of 10 days prior to the date of such written notification to Nepal Investment Bank.

In case of a charge back being made to the Card, the Card would be credited with the said charge back amount.In case the Card is expired, Nepal Investment Bank shall issue a new replacement Card, and shall credit the said amount to the new replacement Card. The said replacement Card shall be valid for a period of 1 and will be renewed once the annual fee is received by the Bank.


Statements and records

The Cardholder shall inform Nepal Investment Bank in writing within 15 days, if any irregularities or discrepancies exist in the transactions/ particulars of the Card Account on any Statement that is made available to the Cardholder. If Nepal Investment Bank does not receive any information to the contrary within 15 days, it shall assume that the Statement and the transactions are correct. All records maintained by Nepal Investment Bank, in electronic or documentary form of the instructions of the Cardholder and such other details (including but not limited to payments made or received) pursuant to the terms and Conditions, shall as against the Cardholder, be deemed to be conclusive evidence of such instructions and such other details.


Exclusion from liability

In consideration of the Nepal Investment Bank providing the Cardholder with the facility of the Card, the Cardholder and the Buyer hereby agree to indemnify and keep Nepal Investment Bank indemnified from and against all actions, claims, demands, proceedings, losses, damages, personal injury, costs, charges and expenses whatsoever which Nepal Investment Bank may at any time incur, sustain, suffer or be put to as a consequence of or by reason of or arising out of providing the Cardholder the said facility of the Card or by reason of Nepal Investment Bank's acting in good faith and taking or refusing to take or omitting to take action on the Cardholder's instructions, and in particular arising directly or indirectly out of the negligence, mistake or misconduct of the Cardholder / Buyer; breach or noncompliance of the rules/ terms and conditions relating to the Card and/ or fraud or dishonesty relating to any transaction by the Cardholder. The Cardholder shall also indemnify Nepal Investment Bank fully against any loss on account of misplacement by the courier or loss- in- transit of the Card. Without prejudice to the foregoing, Nepal Investment Bank shall be under no liability whatsoever to the Cardholder in respect of any loss or damage arising directly or indirectly out of:

  • Any issue emerges post taking services from our Network Hospitals /OPD centers / Doctors / Pharmacy / Healthcare partners;
  • The refusal of any person to honor or to accept the Card other than the network Partner;
  • The malfunction of any computer/POS terminal;
  • Effecting transaction instructions other than by a Cardholder;
  • Handing over of the Card by the Cardholder to anybody other than the designated employees of Nepal Investment Bank at Nepal Investment Bank's premise;
  • The exercise by Nepal Investment Bank of its right to demand and procure the surrender of the Card prior to the expiry date exposed on its face, whether such demand and surrender is made and/ or procured by Nepal Investment Bank or by any person or computer terminal.
  • The exercise by Nepal Investment Bank of its right to terminate any Card;
  • Any injury to the credit, character and reputation of the Cardholder alleged to have been caused by the repossession of the Card and/ or, any request for its return or the refusal of any merchant establishment to honor or accept the Card;
  • Any misstatement , misrepresentation, error or omission in any details disclosed by Nepal Investment Bank except as otherwise required by law, if Nepal Investment Bank receives any process, summons, order injunction, execution distrait, levy, lien, information or notice which Nepal Investment Bank in good faith believes/ calls into question the Cardholder's ability, or the ability of someone purporting to be authorised by the Cardholder, to transact on the Card, Nepal Investment Bank may, at its option and without liability to the Cardholder or such other person, decline to allow the Cardholder to obtain any portion of his funds, or may pay such funds over to an appropriate authority and take any other steps required by applicable law. Nepal Investment Bank reserves the right to deduct from the balance available on the Card, a service charge and any expenses it incurs, including without limitation legal fees, due to legal action involving the Cardholder's Card;
  • Any statement made by any person requesting the return of the Card or any act performed by any person in conjunction;
  • In the event a demand or claim for settlement of outstanding dues from the Cardholder is made, either by Nepal Investment Bank or any person acting on behalf of Nepal Investment Bank, the Cardholder agrees and acknowledges that such demand or claim shall not amount to be an act of defamation or an act prejudicial to or reflecting upon the character of the Cardholder, in any manner.

Treatment liability

Healthcare Partner will be solely responsible and liable for any laps, negligence or improper treatment offered to Cardholders, In no circumstances,Nepal Investment Bank/E-Meditek Global will be liable for any damage, claim or compensation to the Healthcare cardholder on account of any such incidence.


Lost of Card

The Cardholder should contact Nepal Investment Bank as soon as possible at the Card Helpline if the Medicash card is misplaced, lost, stolen, mutilated, not received when due. it should not, under any circumstance be used if found by the Cardholder subsequently, and the Cardholder should cut the card diagonally in half.

Healthcare Partner will be soley responsible and liabile for any laps negligence or improper treatment offered to Healthcare Cardholders, In no circumstances Nepal Investment Bank/EMGPL will be liable for any damage, claim or compensation to the cardholders on account of any such incidence.Nepal Investment Bank/ EMGPL is neither liable nor responsible for any transactions incurred on the card account prior to the time of reporting of the loss of the card, and the card member will be wholly responsible and liable for the same. However it is stipulated that after receipt of proper notification of the loss by bank by any means preferably on call or in writing, the card member shall have no financial liability. Furthermore, in addition to notifying Nepal Investment Bank about the loss or theft of the card, the card member must report any thefts of cards to police and other investigating authorities and lodge a First Information Report (“FIR”).

If the Cardholder has acted fraudulently the Cardholder will be liable for all losses. If the Cardholder acts without reasonable care, the Cardholder may be liable for all losses incurred. This may apply if the Cardholder fails to follow the safeguards as specified by Nepal Investment Bank.


Validity / Termination

The Cardholder may end the Agreement at any time by writing to our Email ID or calling in to Card Helpline, and by cutting the card(s) diagonally. All the cards including the add-on cards will be terminated basis the written request. Termination will be effective after payment of all amounts outstanding on the card account. No annual, joining or renewal fees shall be refunded on a pro-rata basis.

Nepal Investment Bank may also restrict, terminate or suspend the use of The Cardholder Account at any time without prior notice if Bank reasonably believe it necessary for business or security reasons. The Card must not be used after the Agreement ends or while use of Card Account is suspended.


Miscellaneous

The Cardholder agrees to comply with all applicable laws and regulations of ( please insert the name of regulatory body) which govern or may be affected by the use of the Card . The Cardholder is aware of all security risks, including possible third party interception of any of his/her transactions and statements of account on the Internet and the contents of his/her transactions or statements of account becoming known to third parties. The Cardholder agrees and undertakes thathe/she shall not hold Nepal Investment Bank / EMGPL liable therefor in any way. The use and storage of any information, including without limitation, the Card number, PIN, password, account information, transaction activity, account balances and any other information available on the Cardholder’s Internet access device or computer is at his/her own risk and responsibility.


Addition/ Withdrawal Of Facilities:

Nepal Investment Bank may, at its discretion, make available to the Cardholder more services on the Card, POS Terminals, Internet or other wise and/ or other devices through shared networks for the Cardholder's convenience and use. All fees and charges related to Transactions done by the Cardholder at these devices as determined by Nepal Investment Bank from time to time will be recovered by a debit to the balance available on the Card. The Cardholder under stands and agrees that the shared networks may provide different functionalities and service offerings and different charges for different services. Nepal Investment Bank shall also, in its sole discretion, at any time, without notice to the Cardholder, be entitled to withdraw, discontinue, cancel, suspend/ or terminate the facility to use the Card and/ or services related to it, at POS Terminal/ Internet / other devices within Nepal and India and shall not be liable to the Cardholder for any loss or damage suffered by him resulting in any way from such withdrawal, discontinuance, cancellation, suspension or termination.
